Terms Of Service

These Terms of Service (“Terms”) are a legal agreement between you and AHMEDMEDIAGROUP (“AHMEDMEDIAGROUP”, “we”, “us” or “our”) governing your access to and use of our website and our applications and services, including Fleetira, Hirica, Convertable, Sociables, Travelyfe, Tarbiyah and Infyntra (each a “Service”, together the “Services”). They also serve as the end-user licence agreement (“EULA”) for our apps. Please read them carefully.

By downloading, accessing or using any Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) and able to form a binding contract to use the Services. If you use the Services on behalf of an organisation, you confirm you are authorised to bind that organisation to these Terms.

2. Your Account

Some Services require an account. You agree to provide accurate information, keep your credentials secure and remain responsible for all activity under your account. Tell us promptly at [email protected] if you suspect any unauthorised use. You can delete your account at any time as described in our Privacy Policy.

3. Licence

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to download and use our apps on Apple-branded or other supported devices that you own or control, and to use the Services for your own lawful purposes. We reserve all rights not expressly granted.

4. Acceptable Use

You agree not to:

• break the law or infringe the rights of others;
• copy, modify, reverse-engineer, decompile or attempt to extract the source code of a Service, except to the extent permitted by law;
• access the Services by automated means, or interfere with, disrupt or overload them;
• attempt to gain unauthorised access to any account, system or data;
• upload malware, or content that is unlawful, abusive, hateful, harassing, deceptive or infringing;
• resell, rent or commercially exploit the Services without our written permission.

We may suspend or terminate access for conduct that breaches these Terms or harms other users, us or third parties.

5. Your Content

You retain ownership of the content you create, upload or submit through the Services (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and process Your Content solely to operate, secure and improve the Services and to provide the features you use. You are responsible for Your Content and confirm you have the rights necessary to share it.

6. Intellectual Property

The Services, including all software, design, text, graphics and trade marks, are owned by AHMEDMEDIAGROUP or our licensors and are protected by intellectual-property laws. Except for the rights expressly granted to you, nothing in these Terms transfers any ownership to you.

7. Third-Party Services

The Services may interoperate with or link to third-party products and services that are governed by their own terms and privacy policies. We are not responsible for third-party services, and your use of them is at your own risk.

8. Purchases, Subscriptions And Billing

Some Services offer paid features or subscriptions. When you purchase through the Apple App Store, payment is charged to your Apple Account, and subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple Account settings. Except where required by law or by Apple’s policies, payments are non-refundable. Refunds for App Store purchases are handled by Apple. We may change prices and features on a prospective basis with notice.

9. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free or secure. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including your statutory consumer rights.

10. Limitation Of Liability

To the fullest extent permitted by law, AHMEDMEDIAGROUP will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or business, arising out of or relating to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us for the relevant Service in the 12 months before the claim, or £50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

11. Indemnification

You agree to indemnify and hold AHMEDMEDIAGROUP harmless from any claims, losses or expenses (including reasonable legal fees) arising from your misuse of the Services, your violation of these Terms or your infringement of any third-party rights.

12. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue a Service (with reasonable notice where practicable). Provisions that by their nature should survive termination will survive.

13. Changes To The Services And Terms

We may update the Services and these Terms from time to time. When changes are material, we will update the “Last updated” date and, where appropriate, notify you. Continuing to use the Services after changes take effect means you accept the revised Terms.

14. Governing Law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer you may benefit from any mandatory protections of the country in which you live.

15. Apple App Store Terms

The following additional terms apply to any app you download from the Apple App Store, and you acknowledge and agree that:

• These Terms are between you and AHMEDMEDIAGROUP only, and not with Apple. Apple is not responsible for the app or its content.
• Your licence to use the app is limited to a non-transferable licence to use it on any Apple-branded device that you own or control, as permitted by the Usage Rules in Apple’s App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the app. Any support questions should be directed to us at [email protected].
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses are our responsibility, not Apple’s.
• We, not Apple, are responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer-protection or similar claims.
• We, not Apple, are responsible for investigating and resolving any third-party claim that the app or your use of it infringes that third party’s intellectual-property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist-supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you as a third-party beneficiary.
